Terms of Service

1. Who we are

AppeakPro is a service operated by APPEAK PRO LLC, a Texas limited liability company (“AppeakPro,” “we,” “us,” “our”). Our mailing address is 14205 N Mo Pac Expy, Ste 570, Austin, TX 78728-6529, United States. By creating an account or using the service, you agree to these Terms of Service and to our Privacy Policy and Refund Policy.

2. The service

AppeakPro is an App Store Optimization (ASO) platform. The free tier provides rule-based audits of public app store listings. Paid plans add Claude-powered metadata rewrites, keyword research, competitor analysis, and creative direction (collectively, “Optimization Reports”). We currently support iOS App Store listings; Google Play support is rolling out. Features, plans, and limits may change as the product evolves.

3. Your account

You must be at least 18 years old and able to form a binding contract to use AppeakPro. You are responsible for the accuracy of the information in your account, for keeping your credentials secure, and for any activity under your account. Tell us promptly at our contact form if you suspect unauthorized access.

4. Acceptable use

You agree not to:

• Use the service for any unlawful purpose or to violate any third party’s rights;
• Submit app URLs you do not own or have authorization to analyze for the purpose of generating optimization output you intend to publish;
• Reverse-engineer, scrape, or attempt to extract our prompts, models, or proprietary scoring logic;
• Resell, sublicense, or rebrand the service or its outputs as your own product;
• Submit content that is illegal, defamatory, infringing, or harmful;
• Interfere with the service’s operation or attempt to bypass usage limits.

5. Intellectual property

The AppeakPro service, software, scoring engine, prompt templates, and brand are owned by APPEAK PRO LLC. We grant you a limited, non-exclusive, non-transferable license to use the service while your account is in good standing.

Your content and outputs. You retain ownership of the app metadata, screenshots, and inputs you submit. The Optimization Reports we generate for you (titles, subtitles, keywords, descriptions, creative briefs, PDF reports) are licensed to you for your own use, including publishing them on the App Store or Google Play under your developer account. We may use anonymized, aggregated data about service usage to improve AppeakPro.

6. Billing and subscriptions

Merchant of Record. All paid plans are sold and processed by Lemon Squeezy (Lemon Squeezy LLC), which acts as our Merchant of Record. Lemon Squeezy handles payment, tax collection and remittance, invoicing, and chargebacks. You will see “Lemon Squeezy” on your card or bank statement.

Plans. The current paid plan is Beta Starter, available as a $29 USD monthly subscription or a $276 USD annual subscription billed once every twelve (12) months. Prices are in U.S. dollars and exclude any applicable taxes, which Lemon Squeezy adds at checkout based on your billing location.

Auto-renewal. Both the monthly and annual subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account; access continues until the end of the period you have already paid for. We do not pro-rate refunds for unused time after a renewal has been charged.

Price changes. We may change prices for new billing periods with at least thirty (30) days’ notice by email. Existing paid periods are not affected.

7. Refunds

Our refund eligibility rules are described in full on the Refund Policy page. In short: you are eligible for a full refund within 7 days of purchase if no Optimization Report has been generated for your account. Once an Optimization Report has been generated, the purchase is non-refundable. You can cancel future renewals at any time.

8. AI outputs - no guarantees

AppeakPro uses large language models (including Anthropic’s Claude) to generate metadata suggestions, keyword opportunities, and creative briefs. We do not guarantee any particular ranking, download, conversion, or revenue outcome on the App Store, Google Play, or any other platform. App store rankings depend on many factors outside our control, including platform algorithms, competition, app quality, and reviews. You are responsible for reviewing AI-generated content before publishing it and for compliance with the App Store Review Guidelines and Google Play Developer Program Policies.

9. Third-party platforms

AppeakPro is not affiliated with, endorsed by, or sponsored by Apple Inc., Google LLC, AppTweak, or any other third-party platform we integrate with or analyze. Trademarks, product names, and logos referenced in the service belong to their respective owners.

10. Disclaimers

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that defects will be corrected.

11. Limitation of liability

To the maximum extent permitted by law, APPEAK PRO LLC and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the service. Our total aggregate liability for any claim arising out of or related to these terms or the service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim arose, or (b) one hundred U.S. dollars ($100).

12. Termination

You may stop using the service and cancel your subscription at any time. We may suspend or terminate your access if you breach these terms, if your payment fails, or if we discontinue the service. On termination, the licenses granted to you end, but sections intended to survive (Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) will continue to apply.

13. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email or by posting a notice in the app. Continued use of the service after the effective date of the updated terms means you accept the changes.

14. Governing law and disputes

These terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these terms or the service shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.
